Frequently Asked Questions Regarding Overtime

Since the Sheriff's Department began to curtail use of overtime in the last couple of months, questions are being asked about ALADS members rights. Here are examples of questions and the correct answers.
1. QUESTION: Can the Department force me to work for save time instead of paid overtime?
ANSWER: NO. Article 8 Hours work and overtime Section 8. (B) states, "Effective July 1, 1994, compensation for all overtime as defined in this Memorandum of Understanding (MOU) shall, at the employees option, be compensated with pay at the rate of one and one-half times the pay then in effect for the employee, or accrued as Compensated Time Off (CTO) at the rate of one and one half hours for each hour of overtime worked. Accumulation of CTO shall be subject only to the maximum accumulation of 480 hours (resulting from 320 hours of work)."
Further, the provisions of a federal law, FLSA, prohibit an employer to pay overtime with CTO unless an MOU allows it to. The ALADS MOU does not give the Sheriff’s Department the right to pay you CTO instead of cash, UNLESS you want to be compensated in CTO.
2. QUESTION: We were told that if we take CTO instead of cash, we could cash it out later, is this correct?
ANSWER: NO. Currently, the MOU does not allow you to be paid for CTO on the books until/unless you terminate employment with the County.
