Federal Court Revises Order Names and Addresses of Deputies Will Not Be Released

On Friday, August 7, 2009, the Federal court which previously ordered the Department to release the names and addresses of all Deputy Sheriffs to a third party in connection with a donning & doffing lawsuit, revised that order. In response to objections from two deputies, as well as ALADS on behalf of all Deputies, the Judge revoked the portion of her order which required released of names and addresses and instead ordered the Department to send notice of the donning & doffing suit to all currently employed Deputies by email. The notice will be sent to retired deputies by U.S. Mail, but it will be sent by the Department not a third party.
The donning and doffing suit which led to the court’s order to release names and addresses is known as Lockhart v. County of Los Angeles, and is not the lawsuit filed on behalf of ALADS members. The Plaintiffs’ attorney in the Lockhart lawsuit sought the order to release Deputies’ names and addresses to a third party. The Lockhart suit seeks the same relief as the suit filed by ALADS members.
If you are one of the nearly 2,600 deputies who have already opted in to the ALADS members’ suit, YOU DO NOT NEED TO OPT-IN TO THIS OTHER ACTION. If you have already opted-in to the ALADS members suit, or your do not wish to participate in the Lockhart lawsuit, you do not need to read or respond to the e-mail which will sent by the Department in the next few days.
The notice which the Department will be emailing to you in the next few days will provide you with contact information for the Department’s attorneys in the Lockhart lawsuit as well as the attorneys for the non-ALADS members in that suit. ALADS has just sent out to all Deputies, by U.S. Mail, a second reminder regarding the ALADS members’ donning & doffing case. If you have not yet opted in to this suit and would like to join 2,600 of your partners in this litigation, sign and return the opt-in form which you received from ALADS at your earliest opportunity.
